DUI in Delaware, A Summary

  • When you get pulled over for DUI there are two main categories: probable cause and refusal to take the DUI tests. Under probable cause, you will be charged with DUI if you have a BAC over .10% based on the chemical test. A chemical test will reveal any drugs in your blood or urine.

  • If your BAC is under .10%, the police officer can still arrest you for being under the influence of alcohol. For some folks, a lower BAC can cause you to drive unsafely. It is good to know your limits.

  • In the Driver's Manual you learned about implied consent and your automatic agreement to drug and alcohol testing as part of obtaining a Delaware driver's license. Still, you always have the right to refuse testing.

  • The BAC test is the basis of most DUI arrests and without the test, arresting police officers may not be able to prove you are DUI. In the end, you will still lose your license if you refuse the chemical tests.

  • You may be unfit to drive if you have trouble staying in your lane, don't accelerate evenly, and have impaired reaction time. As a passenger you will want to know the signs of DUI and never ride with anyone who decides to drink and drive.

  • Drinking and driving doesn't apply just to cars and trucks. You can be charged with DUI when operating an OHRV or moped too. Your safety and the safety of others around you can be jeopardized when alcohol and motor vehicles are mixed. In fact, 38% of fatal accidents in Delaware involve alcohol. The good news is there is plenty of fun to be had in Delaware, even with the omission of intoxicating substances. With nature, restaurants, shops, and activities abound, it is easy to party responsibly in Delaware. Consider a trip to the state’s well-known Rehoboth Beach, where the mile-long boardwalk gives way to tons of entertainment suitable for any lifestyle. For those with a more adventurous nature, why not travel just south of Rehoboth Beach to Dewey Beach? This oceanic retreat offers a variety of activities and events, including skimboarding championships and the annual Dewey Beach Music Conference in September. Another terrific seaside location perfect for Delaware fun is the Delaware Seashore State Park, which permits swimming, boating, and fishing in either the Atlantic ocean or in the Indian River Bay.

For those less interested in an ocean adventure, a visit to the Brandywine Creek State Park may be just the ticket for peace of mind and entertainment in Delaware. You can explore the nearly two centuries old tulip poplar trees in Tulip Tree Woods, not to mention its freshwater marsh complete with native birds. Catch your dinner in one of the parks two creeks or take a hike through one of the parks 4 hiking trails, which range from easy to intermediate in difficulty.
